Scope and applicability

These Terms and Conditions (“Terms”) apply to all use of the website www.kospureaqua.com and to all orders of products and services offered by Kos-PureAqua FlexCo (“we”, “us”, “our”).

They apply to:

• Consumers (B2C) within the meaning of the Austrian Consumer Protection Act (KSchG), and
• Business customers (B2B).

Where provisions differ, this is explicitly stated.

Definitions

• Customer / you: the person or legal entity placing an order
• Products: water reuse systems, water conditioning/softening systems, and related equipment
• Services: advisory, installation coordination, maintenance, or support services where expressly agreed
• Website: www.kospureaqua.com
• Order: your binding request to purchase Products

Order process and contract formation

Order request

By placing an order or requesting a quotation, you submit a binding offer to purchase Products.

Quotation and payment

Upon request or order, we issue a written quotation.
If you accept the quotation, you will receive a retainer or advance invoice (unless otherwise agreed in writing).

Contract formation:
A legally binding contract is concluded only once full payment of the retainer/advance invoice has been received and confirmed by us in writing.

We reserve the right to refuse or cancel orders in cases of:

• product unavailability,
• pricing or description errors,
• suspected fraud or abuse,
• failure to meet legal or technical requirements.

Prices and payment

Prices

• All prices are stated in EUR.
• VAT is included where applicable and legally required.
• Shipping, transport, customs, and handling costs are additional, unless expressly stated otherwise.

Payment methods

We accept:

• Stripe (credit/debit card payments), and
• Bank transfer.

Payment must be received in full in advance, unless otherwise agreed in writing.

Product information and technical suitability

Product descriptions

Product descriptions, images, and specifications are provided in good faith. Minor deviations may occur.
Technical data sheets prevail over marketing descriptions.

Technical responsibility

Our Products are technical systems. You are responsible for ensuring that:

• your property and infrastructure are suitable,
• local water quality and pressure are compatible,
• all permits and approvals are obtained, and
• installation complies with applicable laws and standards.

We strongly recommend consultation with qualified professionals prior to purchase.

Delivery and transfer of risk

Delivery area

We currently deliver within the European Union.
Other regions require individual agreement.

Delivery times

Delivery times are estimates only and not guaranteed. Delays caused by logistics providers, customs, force majeure, or third parties do not constitute breach of contract.

Risk transfer

Risk of loss or damage transfers to the Customer upon delivery.

Any visible transport damage must be reported within 48 hours of receipt.

Right of withdrawal (B2C only)

Withdrawal period

Consumers have the right to withdraw from the contract within 14 days without giving reasons.

The withdrawal period begins on the day the Products are received.

Exercising withdrawal

Withdrawal must be declared by a clear statement (email or letter).
Use of the model withdrawal form is optional.

Return and refund

• Products must be returned within 14 days of withdrawal.
• The Customer bears return shipping costs.
• Refunds are made within 14 days after receipt of returned goods or proof of return.

Exclusions from withdrawal

The right of withdrawal does not apply to:

• custom-made or configured Products,
• Products that have been installed or integrated,
• sealed Products opened for hygiene or safety reasons,
• services fully performed with prior consent.

Warranty and defects

Statutory warranty

Statutory warranty rights under Austrian law remain unaffected.

Manufacturer warranties

Where applicable, manufacturer warranties apply in addition to statutory rights.

Exclusions

Warranty does not cover:

• normal wear and tear,
• improper installation or use,
• unauthorized modifications or repairs,
• failure to follow operating or maintenance instructions,
• damage caused by external factors (e.g. water pressure surges, electrical faults, environmental damage). 

Liability

Consumers

Nothing in these Terms limits liability for:

• death or personal injury caused by negligence,
• fraud or gross misconduct,
• mandatory product liability.

Business customers (B2B)

To the maximum extent permitted by law:

• liability for indirect, consequential, or economic loss is excluded,
• total liability is limited to the net purchase price of the affected Product.

Installation

We are not liable for damage arising from self-installation or third-party installation unless caused by a proven defect in the Product itself.

Intellectual property

All website content, designs, texts, images, and technical documentation remain our intellectual property or that of our licensors. No rights are granted except as strictly necessary to use the website and Products.

User conduct

You may not misuse the website, interfere with its operation, or attempt unauthorized access.

We reserve the right to suspend or restrict access in case of violations.

Force majeure

We are not liable for non-performance caused by events beyond reasonable control, including natural disasters, war, pandemics, supply chain disruptions, or governmental actions.

Governing law and jurisdiction

• Governing law: Austrian law
• Consumers: courts of your place of residence
• Business customers: courts of Austria

Amendments

We may amend these Terms. Updated versions will be published on the website with a revised date.

Severability

If any provision is invalid, the remaining provisions remain effective.
